After the jury is selected, the trial is ready to begin. The prosecution usually opens the case, explaining briefly to the jury the nature of the charge against the accused and what facts the government intends to establish.
The prosecution then introduces its witnesses. After the prosecuting attorney has questioned each witness, the defense attorney has the right to question – or to cross-examine – the witness. The process of cross-examination has been characterized as the greatest legal engine ever invented for the discovery of the truth. With the completion of the prosecution’s case, the defense makes its opening statement in a similar manner and introduces its witnesses, who are then cross-examined by the opposing side.
The examination and reexamination of witnesses, which form the substance of the criminal trial, are governed by so-called rules of evidence. The rules of evidence are many and complex, and their rationale is not always clear. Certain types of testimony are prohibited from being brought before the jury, primarily on the grounds that such evidence is almost certain to take jurors away from the truth rather than bring them closer to it.
